General conditions of SCANDY.ch by Planitech Sagl for online sales (distance contracts)

1. General information

1.1 These general conditions (the “General Conditions”) are governed by Legislative Decree 6 September 2005 n. 206 ("Consumer Code") containing the provisions for the protection of consumers and in particular articles 50 to 68 relating to distance selling.

1.2 The General Conditions apply to purchase orders for products (the “Products”) issued online on this website (the “Site”) for deliveries to be carried out exclusively in Italy (including the Republic of San Marino and the City of the Vatican) and the EU. It is not possible to order the Products to be delivered outside Italy (with the exception of the Republic of San Marino and the Vatican City) and the EU.

1.3 By ticking the "I accept the Terms and Conditions" box that appears during the online purchase procedure in the "Shop" section, the buyer accepts all the contractual conditions set out below. In the absence of express acceptance of the General Conditions, it will not be possible to complete the online purchase procedure.

1.4 SCANDY.ch by Planitech Sagl. reserves the right to modify the General Conditions at any time without notice. However, the changes will not be valid for purchase orders that were sent before the changes were published on the Site.

1.5 For the conditions of use of the Site and the privacy policies, please refer to the “Terms & Conditions” of the “SCANDY.ch” website as well as the “Privacy Policy” below.

1.6 By accepting the General Conditions and therefore by issuing the purchase order, the buyer expresses consent for all communications to be sent and received via email. The cost of using the communication technique depends on the tariff applied by the internet service provider.

1.7 The buyer will be responsible for the correctness of the email address and all information entered when placing the order or opening his account.

2. Issuance of the order and purchase conditions

2.1 The buyer will be able to purchase the Products by accessing the "Products" section of the Site. The purchase order will be automatically issued at the end of the order issuing procedure in the "Products" section. Only the Products present in the online catalog of the Site in the "Products" section at the time the order is issued can be purchased.

2.2 Correct receipt of the order will be confirmed by SCANDY.ch via email communication sent to the email address provided by the buyer. The confirmation message will report the essential characteristics of the purchased good, the price of the purchased product including taxes and additional duties, delivery costs. The confirmation message will contain the order identification number to be used in any subsequent communication with Planitech Sagl.

2.3 The Products offered on the Site are limited in number. It may therefore happen, also due to the possibility that multiple users purchase the same Product at the same time, that the ordered Product is no longer available following the transmission of the purchase order.

2.4 In case of failure to execute the order due to unavailability - even temporary - of the Products, the buyer will be informed by email sent to the email address provided with indication of the new delivery deadline.

3. Delivery

3.1. Delivery of the Products is expected in: Italy and the EU.

3.2 Delivery time of the Products from sending the order: 5-10 days, or in any case within the maximum period of thirty days from the date of confirmation of the order. The delivery date indicated in the order confirmation must be considered purely indicative.

3.3 It is up to the buyer to check the conditions of the delivered Product. It is recommended to check the number of Products received and that the packaging is intact, not damaged, nor wet or otherwise altered, even in the closing materials and you are invited, in your interest, to indicate on the carrier's transport document, any anomalies, accepting the package with reserve. If the package shows obvious signs of tampering or alteration, it is advisable to promptly notify info@planitech.ch.

4. Prices and delivery costs

4.1 All prices of the Products contained in the online catalog of the "products" section are expressed in Euros. All prices must be considered inclusive of VAT and do not include delivery costs. The Products are sold at the list prices in force at the time the order is issued.

4.2 Delivery costs are indicated during the order issuing procedure (€15.50 for orders of less than €500.00). Delivery costs may be subject to change, however such changes will not have value for purchase orders issued before the publication of the changes on the Site.

4.3 The buyer undertakes to reimburse Planitech Sagl. any additional expense that the same has had to sustain for shipments or handling caused by a failure by the buyer to comply with the agreements made for the date, time and place of delivery.

4.4 Delivery costs for disadvantaged areas, islands and Venice Lido may be subject to variations.

5. Payment method

5.1. You can purchase via payment cards. The debit will be made only after the details of the payment card used have been verified and the issuing company of the payment card used has issued the debit authorization. In application of Directive 2015/2366/ (EU) on payment services in the internal market (PSD2), the user is informed that he may be required to complete the purchase process by satisfying the authentication criteria required by the payment institution responsible for manage the online payment transaction. The authentication criteria refer to the user's identity (to satisfy this criterion the user must be registered on the Site at the time of the purchase transaction) and to the contextual knowledge of the authentication code transmitted by the payment institution (Strong Customer Authentication ). Failure to complete the procedure described above may make it impossible to complete the purchase on the Site. The confidential data of the payment card (card number, holder, expiry date, security code) are encrypted and transmitted directly to the manager of the payments without passing through the servers used by the Seller. The Seller therefore never has access to and does not store, even if you choose to store such data on the Site, the payment card data used to pay for the Products. The footer of the Site indicates the payment card symbols that can be used on the Site.

5.3 It is not possible to pay by bank transfer or cash on delivery.

5.4 It is also possible to make purchases using the PayPal payment solution. If you choose PayPal as a means of payment, you will be redirected to the website www.paypal.it where you will make the payment according to the procedure established and regulated by PayPal and the terms and conditions of the contract agreed between the user and PayPal. The data entered on the PayPal website will be processed directly by PayPal and will not be transmitted or shared with the Seller. The Seller is therefore not able to know and does not store in any way the payment card data connected to your PayPal account or the data of any other payment instrument connected to this account.

6 Right of withdrawal, non-compliant products

Section I: right of withdrawal

6.1 The buyer has the right to withdraw from the purchase contract - without any penalty and without specifying the reason - within 14 working days from the date of delivery of the Product.

6.2 To exercise the right of withdrawal, the buyer must inform the Seller, before the expiry of the Withdrawal Period, by communicating the decision to withdraw to info@planitech.ch, or using the contact form on the Site. The Product must be delivered to the Seller's headquarters, or to a different address communicated by the Seller. The Withdrawal Period expires after 14 days.

6.3 The substantial integrity of the Product to be returned is an essential condition for exercising the right of withdrawal. The right of withdrawal, therefore, cannot be exercised if the buyer has not taken adequate measures to ensure that the Product can be returned in the same conditions in which it was received (including the original packaging).

6.4 The costs for returning the Product will be free, if the product is defective at the origin, for other reasons the shipping costs will be borne by the buyer.

6.5 If the buyer has already made one or more payments, these will be refunded by the Seller within thirty days from the date on which the communication relating to the right of withdrawal is received and without further costs for the buyer.

Section II: non-compliant products

6.6 Except as established for the right of withdrawal, the buyer, who is also a consumer, will also have the right to resort to legal remedies provided for in Part IV Title III Chapter I (from article 128 to 135) of the Legislative Decree of 6 September 2005 n. 206 ("Consumer Code") relating to any lack of conformity of the Product existing at the time of delivery.

6.8 Any defects in conformity of the Product must be reported within the terms and methods set out in article 132 of the Consumer Code to the e-mail address info@planitech.ch.

7 Assembly and use

7.1 Products and accessories purchased online must always be assembled following the instructions provided with the goods.

7.3 The Buyer is responsible for the correct assembly and correct use of the Products purchased online.

7.4 The Seller assumes no responsibility for complaints attributable to unexpected use of the Product, its manipulation, or errors in assembly.

8 Assistance and maintenance

9 Force majeure

9.1 The seller will not be held responsible for failures or delays in the execution of the order in the event that such failures or delays are caused by impediments such as work interruptions, trade union unrest, suspension of transport, atmospheric events or disasters and any other cause which may integrate an impediment due to force majeure or unforeseeable circumstances.

10 Applicable law

10.1 The General Conditions are governed by Italian law.

10.2 For any dispute relating to the General Conditions, the court of residence of the buyer will be competent, in the event that he is a consumer. In all other cases, the territorial jurisdiction will be exclusively that of Verbania.
